GENERAL CONDITIONS OF USE OF STUDIO BASTILLE'S GRAPHICS

 This document defines your rights and obligations with respect to the graphics included in the STUDIO BASTILLE CD-Rom.
 You acknowledge having read these general conditions of use of STUDIO BASTILLE graphics before ordering the CD-Rom  or before removing the CD-Rom wrapping.

          All the graphics of the CD-Rom are protected by copyrights STUDIO BASTILLE holds all these copyrights and only grants   you a license to use certain copyrights, as defined hereinafter.

 I. LICENSE TO USE THE GRAPHICS  

 In compensation for the payment of the full price of the CD-Rom, STUDIO BASTILLE hereby agrees to grant a license to you on the following copyrights:
 · With respect to representation rights, the right to communicate all or part of the graphics to a public by any means, 
· With respect to reproduction rights, the right to reproduce the graphics by any means  in order to use them as visual backgrounds:
 - on the following papers surfaces only for use in a maximum size A4 (21 x 29,7 cm) press, publishing, promotional documents
 (brochures, annual reports, etc.), packaging,
- on any multimedia or on-line data processing system with a resolution inferior or equal to 72 dpi, all other reproduction of the graphics on the Internet or any other  paying network excluded.

The assignee of the copyrights is not entitled to reproduce the graphics on a medium or products meant for sale, if these graphics are the principal graphic elements of these products or media
(e.g.: postcards, posters, clothes). Such use of the graphics requires 
the prior and express authorisation of STUDIO BASTILLE, i.e a. complementary copyright licence.
 
 This copyright license is non-exclusive and is valid in any country of the world. It shall last during the whole duration of the protection of the graphics by copyrights.  

 The copyright license is not assignable to a third party, if such party does not legally own the STUDIO BASTILE CD-Rom.

 Furthermore you hereby commit yourself not to use STUDIO BASTILLE graphics in an immoral, slanderous, pornographic or illegal context.You commit yourself,
as a consequence, to compensate STUDIO BASTILLE for any and all loss whatsoever that our company
 may suffer in case of infringement of any provision contained herein.

 II.GUARRANTY

STUDIO BASTILLE hereby warrants, during the 30-day-period following the date of delivery of the CD-Rom, that the graphics and the media are free from any defect which might hinder the use of the license granted herein above.

  III. LIMITS OF RESPONSIBILITIES

STUDIO BASTILE shall not be responsible nor liable for any and all direct or indirect damages and/or loss linked with or connectedto the use of the graphics.
STUDIO BASTILLE shall by no mean be bound to repair such damages.

 IV. TERMINATION

In case of infringement of any or all of the provisions herein, STUDIO BASTILLE shall be entitled to terminate at any time this copyright license,
by formal notice made by registered letter with acknowledgement of receipt.

V. APPLICABLE LAW-JURIDICTION

 This agreement is governed by and construed exclusively by French internal law.  
In case of dispute on the validity, interpretation and /or application of any or all of the provisions of this agreement, such dispute shall be brought tothe competent tribunal of  Paris (France).  

  This agreement is a translation oF the French General Conditions of use of STUDIO BASTILLE graphics.  In case of discrepancy between this agreement and the French version, the French version shall prevail.
